What this policy covers
This policy explains what information FileMyScorp (operated by MI Tax LLC dba FileMyScorp) collects when you use our IRS Form 2553 filing service, how we use it, who we share it with, and how you can request changes or deletion.
What we collect
To prepare and file Form 2553 we collect:
- Business information — legal name, EIN, entity type, state of formation, date formed, business address.
- Shareholder information — name, address, Social Security Number (SSN), shares owned and percent ownership, date acquired, tax-year end.
- Officer information — name, title, email, phone number for the officer signing the form.
- Late-election context — if you're filing under Rev. Proc. 2013-30, the reasonable-cause reason codes and any optional explanation you provide.
- Account information — your login email and authentication credentials, used to give you access to your filings and dashboard.
- Payment information — handled directly by our payment processor. We do not see or store credit-card numbers on our servers.
- Communications — emails you send us and our replies.
How we use it
We use the information you provide to:
- Generate IRS Form 2553 with the data you supplied.
- Route your form to shareholders for signature collection in our in-browser signing portal.
- Fax the signed form to the IRS and send a backup paper copy via USPS Certified Mail with return-receipt tracking.
- Email you status updates as your filing progresses (sent for signature, signed, faxed, mailed, IRS acceptance letter received).
- Store the signed form and IRS acceptance letter (when received) in your secure dashboard so you can reference them later.
- Authenticate you when you sign in and protect your account from unauthorized access.
Who we share it with
We share your information only with the third-party service providers we use to deliver this filing service:
- The Internal Revenue Service — your Form 2553 (with EIN, business info, shareholder names + SSNs + addresses, officer signature) is faxed and mailed to the IRS as part of the filing.
- FileMyScorp in-browser signing portal — each shareholder receives an email with a secure one-time link and signs Form 2553 directly in their browser for the corporation's internal records. We do not share signature data with any third-party signing platform.
- Sinch Fax — to transmit the signed form to the IRS fax number.
- PostGrid — to print and certified-mail the signed form to the IRS service center as a backup paper copy.
- Supabase — our database and authentication provider; data is encrypted in transit (TLS) and at rest.
- Vercel — our application hosting provider.
- Our payment processor — to charge the platform-usage fee for your selected delivery channel ($49, $50, or $99).
We do not sell, rent, or trade your personal information to third parties for marketing purposes. We do not use your data for advertising.
Federal tax law — your IRC §7216 rights
Because FileMyScorp is operated by a licensed tax practice (MI Tax LLC) and we prepare a tax-related form on your behalf, we are governed by Internal Revenue Code Section 7216 and Treasury Regulation § 301.7216. These federal rules make it a criminal offense for a tax-return preparer to disclose or use your tax-return information for any purpose other than preparing your return, except in the narrow situations the regulations expressly allow.
What this means for you:
- We use your tax information only to prepare and file your Form 2553 with the IRS.
- We will not disclose your tax information to any third party for any other purpose without your separate, specific written consent.
- If we ever wanted to use your information for anything beyond preparing your Form 2553, we would first obtain a separate §7216 consent from you that meets the requirements of Rev. Proc. 2013-14.
- The service providers necessary to prepare and deliver your form (our fax provider, certified-mail provider, hosting and database provider, and payment processor) operate under the exceptions permitted in Treas. Reg. § 301.7216-2 and are contractually bound to keep your information confidential.
How we protect it
All data is transmitted over TLS-encrypted connections. Sensitive fields (EIN, SSN, account credentials) are stored in encrypted form in our database. Access to production data is restricted to authorized personnel and protected by multi-factor authentication.
How long we keep it
Unless you delete it sooner (see below), we keep your information for the following periods so we can support your filing and meet tax-recordkeeping norms:
- Form 2553 filings and related records — up to seven (7) years from the filing date, consistent with standard IRS recordkeeping recommendations.
- Account information (name, email) — for the life of your account.
- Payment records — retained by our payment processor per their financial-records requirements; we do not store card numbers.
- Deletion records — when you delete a filing or your account we keep a small, non-sensitive log entry (what was deleted and when, with no SSNs, EINs, or form contents) so we can confirm the deletion later.
You can permanently delete your data yourself, at any time. From your dashboard you can archive a filing and then delete it, and from your Account & Privacy page you can delete your entire account. Deletion is immediate and irreversible — it removes the Form 2553, the signatures, every faxed/mailed copy, and any IRS letter, and we cannot recover them afterward, so keep your own copy of anything you need for your records. You can also email info@filemyscorp.com and we'll delete it for you. Where we are independently required by law to retain a specific record, we'll tell you what we must keep and why.
Your rights
You have the right to:
- Access a copy of the personal information we hold about you.
- Correct inaccurate information by editing your filing in progress or emailing us if the filing has been completed.
- Request deletion of your account and associated records, subject to the retention rules above.
- Opt out of non-essential email communications.

California, Colorado, Virginia & similar state privacy rights
If you reside in a U.S. state with a comprehensive consumer privacy law (California CCPA/CPRA, Colorado CPA, Virginia VCDPA, Connecticut CTDPA, Utah UCPA, and similar regimes), you have the additional rights to:
- Know what categories of personal information we've collected about you in the past 12 months and the purpose for which it was collected.
- Request a copy of the personal information we hold about you in a portable format.
- Correct inaccurate personal information.
- Delete personal information we've collected, subject to the retention rules above (we retain filing records for at least 7 years to honor IRS recordkeeping requirements).
- Opt out of sale or sharing of personal information for cross-context behavioral advertising. We do not sell or share personal information for advertising — period. So this right has nothing to exercise here, but you have it.
- Non-discrimination — exercising any of these rights will not affect the price you pay or the level of service you receive.
The fastest way to access or delete your data is to do it yourself: from your Account & Privacy page you can download a copy of everything we hold and permanently delete individual filings or your whole account.
You can also email info@filemyscorp.com from the address on your FileMyScorp account, or write to us at the address in the “Contact us” section below. We respond to verifiable requests within 45 days, as the relevant statutes require, and may need to verify your identity first. You may use an authorized agent to make a request on your behalf; we will require written proof of their authorization and may confirm the request with you directly.
Children's privacy
FileMyScorp is not intended for users under 18. We do not knowingly collect personal information from children.
Changes to this policy
We may update this policy from time to time. Material changes will be reflected in the “Last updated” date at the top of this page.
